The following Terms & Conditions (hereinafter: T&Cs) shall apply to any Tour booked with Gozo Your Own Way Ltd. (Operating as Kayak Gozo)

1. You will be assisted throughout the Tour by a qualified Guide. Please pay attention to the Guide’s instructions during the Tour and adhere to them. You shall not be deemed to fall within the responsibility of Kayak Gozo if you leave the whereabouts of the Guide during the Tour or if you fail to follow the instructions given by him/her.

2. Safety comes first! Kayak Gozo observes strict health and safety procedures and will do its best to ensure that your Tour is a safe and enjoyable one. Bear in mind, however, that the Tour does carry an element of risk. If you or any minor under your supervision suffer from any psychological or physical condition or other issue that may affect your/his/her ability to fully participate in the Tour, you are hereby bound to inform a Kayak Gozo representative before the start of the Tour.

3. Please make sure to adhere to any pandemic related measures to prevent the potential spread of any human-to-human virus (e.g. SARS-CoV-2, influenza) as defined by the Maltese government.

4. You will be provided with a personal floatation device and you will be bound to wear it throughout the Tour; from beginning to end. Kayak Gozo recommends you have a personal travel / medical insurance before participating in a Tour.

5. A safety briefing will be given before every Tour. Once the briefing ends you will be deemed to have understood all aspects thereof. In case of difficulty, please let a representative of Kayak Gozo know before participating in the Tour.

6. Swimming is an unguided part of the tour and is undertaken at your own risk. Make sure where you are swimming is safe and do not to swim through any underwater obstacles.

7. Please make sure to stay hydrated during the Tour. We recommend that you bring at least 1.5 litres of water per person.

8. Personal data gathered by Kayak Gozo shall be treated in confidence, and shall be processed in terms of the Data Protection Act, Chapter 586 of the Laws of Malta. Photos/videos taken by Kayak Gozo will only be digitally shared with you and other members of your Tour and will only be used for promotional purposes connected with Kayak Gozo if you consent to this. Said consent may be withdrawn at any time by sending an email to the following email address: info@kayakgozo.com.

9. By signing this form, you guarantee that any minors under your supervision are at least 8 years old. Any child under the age of 15 must be in a double kayak with an adult and children aged 8 and 9 must be in a double kayak with a parent.

10. This experience may not be for everyone. You hereby warrant and represent that you do not suffer from any medical or health condition which may negatively impact your health or endanger your life or the life of others during this experience. Pregnant women of 28 weeks or more are not permitted to join our tours for insurance reasons.

11. Kayak Gozo and our Guides cannot be held responsible for personal injury, loss of equipment, damage or delay when this is not the result of its/their fault, or where this occurs as a consequence of not following instructions given, or when this is the result of a breach of these T&Cs or a breach of law.

12. You will indemnify, defend and hold Kayak Gozo harmless from any claims, demands and actions asserted against it by any person for personal injury, death, or loss of or damage to property resulting from your act or omission.

13. Kayak Gozo shall have no liability in respect of the performance of its obligations as are prevented by an event of force majeure. Without prejudice to the generality of the aforesaid, Kayak Gozo reserves the right to make changes to the schedule, route or to cancel any Tour due to health, safety, weather or other condition.

14. Kayak Gozo reserves the right to refuse service, provided that in any such event the price paid shall be refunded in full and final settlement.

15. By signing this document you confirm to have read and understood these T&Cs and to undertake to abide by these T&Cs and take full responsibility for ensuring that any minor (child or teenager age 17 or younger) in your group abides by the same.

16. These conditions shall be interpreted &construed in accordance with Maltese law. Maltese Courts shall have exclusive jurisdiction.
